The Golden Ad Promotion – Terms & Conditions

What is it?

Gumtree . com Limited, a company incorporated in England and Wales with its registered office at 1 More London Place, SE1 2AF, London, UK (“Gumtree”) is running a promotion (“Promotion”).

The Promotion will involve Registered Users entering a prize draw by finding the Christmas Giveaway advert on Gumtree and replying to the advert during the Promotional Period. Only one entry per Registered User per day during the Promotional Period. Any further entries will not be counted. All valid entries will be entered into a prize draw and one winner will be randomly selected by Gumtree.

“Registered User(s)” are users who sign up for, or who have a standard Gumtree account during the Promotional Period.

Professional accounts cannot enter the Promotion. Please refer to “Who can enter?” below.

Replies to the advert as outlined above using professional tools, such as (but not limited to) API feeds, are excluded and replies are only be eligible for this Promotion if they were posted manually by Registered Users. Please refer to “What’s excluded?” below.

To take part in this Promotion, users must be registered as resident in the UK. Please refer to “Who can enter?” below.

The prize

When is it?

The promotion will be held from 9am on 2nd December to 12pm on 13th December 2019 (“Promotional Period”). Any entries received outside of the Promotional Period will not be considered.

The winner will be contacted by their registered email address within 14 days from the end of the Promotional Period to be informed they have won the prize.

Entrants are responsible for ensuring that they can be contacted via their registered email address. If Gumtree or its authorised agents are not able to contact the winner by midnight 5 days after the first attempted notification, Gumtree reserves the right to select an alternative winner and the original winner’s entitlement will lapse.

Who can enter?

Only Registered Users who have a standard account (i.e. any account that is not a professional account) who are registered on the Gumtree website, applications or tools, who reside in the UK, who are aged 18 years or over and who comply with these Terms & Conditions are eligible.

Users who have a professional account on the Gumtree website, applications or tools cannot enter this Promotion.

All employees (and their families) of Gumtree . com Ltd, any affiliates, subsidiary companies, any representatives or agents of those companies and anyone else who may be professionally involved with the Promotion cannot enter this Promotion.

What’s excluded?

• Any entries which do not comply with Gumtree’s Terms of Use do not benefit from the Promotion.
• Any entries submitted through professional or automated tools, such as (but not limited to) API feeds, are excluded from this Promotion.

General

Gumtree reserves the rights to:

• suspend, change or cancel the Promotion at any time, in the event of circumstances arising which, in Gumtree’s opinion, make it necessary for it to do so;
• add additional terms and conditions for certain parts of this Promotion;
• exclude users on the basis that Gumtree believes that they do not respect Gumtree’s Terms of Use or that their entries are not of the requisite standard; and/or
• verify the eligibility of entrants.

Any decision of Gumtree regarding any aspect of this Promotion is final and no correspondence will be entered into.

By entering the Promotion, all entrants irrevocably grant Gumtree permission to use their name and image for advertising, promotional or publicity purposes.

These Terms & Conditions and the Promotion are governed by English law. By entering, entrants agree to be bound by these rules and Gumtree’s Terms of Use.

Gumtree shall not be liable, in contract or tort (including negligence) or breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit Gumtree’s liability for death, personal injury or fraud.

Gumtree does not accept, and is not responsible for, any lost or delayed entries. Gumtree reminds entrants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion.

Although Gumtree will use reasonable efforts to ensure that all information relating to the Promotion (“Promotional Material”) is accurate, Gumtree is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect Gumtree’s operation of the Promotion or the site, including without limitation the accuracy of any Promotional Material.

Gumtree may use third parties to facilitate one or more elements of the Promotion and Gumtree may provide some of your personally identifiable information to them.
