Probation ending late

Hi,

Are there any grounds for appealing a termination of an employment contract after the probation, as it was done too late and hence not following procedure. e.g if I was given a 6 month probation from my start date 1st January until 1st July, but my probation meeting and termination occurred on 3rd July, would this be an error in procedure and hence a grounds for appeal?

    Nope.

    during your first two years of employment, you can be 'let go' for any reason that isn't discriminatory.

    Probation is generally irrelevant: it's a useful 'marker' for the company, and they may offer a slight change to terms and conditions after it's been successfully completed, but it has no legal status whatsoever.

    Absolutely not. Probation periods can be extended; the 6 month date might fall on a weekend or Bank Holiday; the person or people required for the review might not be available on that date. The list goes on, plus, as said by Savvy_Sue you can be released without any reason given in the first 2 years, as long as the termination of employment can't be shown to be discriminatory.

    If you were terminated on 3rd July it would be too late to make a claim in any case - you had three months from your dismissal.
  • You could not appeal the decision to dismiss.

    Unless you had received notice of satisfactory completion of the probationary period and then were entitled to more notice than they have given or paid for, then there is nothing to claim regarding the dismissal itself.
