Pleeeeeease help - desperate

Hi everyone.
Bit scared about all this. Long story but here goes......_pale_
We, my partner and I, are havin serious money problems. Waiting to hear from the high court about this test case on reclaiming bank charges - owed over £5k from Lloyds.
Sadly my mum passed away last year and as a result of this she left her entire estate to me, not her partner. As a gesture i am letting him live there rather then turf himout on the street. He is paying the rest of the mortgage - about £3k.
I went ot the bank the other day to check on my bank balance at the ATM and my card was taken. When i contacted the bank the said that because we were £300 over our agreed overdraft they were putting a stop on all cheques and we could no longer use our debit cards. They are still sending us letters saying they have paid certain items and slapping charges on top so basically when next months wages go in , we have paid back the overdraft and the charges on top we are gonna be back to square one again:mad:
It just seems like i am sitting on all this money and get get access to it - my mums flat and the result of the test case.
Can anyone maybe suggest something?
One thing i wondered is that can i get some of the money out of my mums flat without kicking her partner out or increasing his mortgage payments?
All advice very welcome as i am at my wits end now and often sit there crying worrying about it all

Not being funny but maybe you will have to take the bull by the horns and ask the partner for rent. Was any of the estate in cash? Or jewelry that you could sell. Needs must and all that.
other than that if you look at southern scousers sticky at the top of the forum, it will show you how to do a statement of affairs. We can help you better if we have a bit more information.
But for a start I would get both of you a basic account from another bank (one you have no financial ties with now), and then transfer over your wages and your direct debit bill payments to that. If the wages are going in there then your direct debits will at least be paid, so you won't be accruing charges ref bouncing direct debits.

One other thing, if you have charges on credit cards then you can still pursue these, it is only bank charges claims that have been put on hold

Hi are you in any other debt? did your mam just have a flat and no money.
I think more info is needed here.I would presume your mam left you her flat to ensure that it did not go to her partners family but obviously she did not want him out on the street. Also if he is paying the mortgage is this classed as his rent?Make £11,000 in 2011 / ebay £6000 -
Would it be possible to sell it on but with a live in tenant agreement? That way he wouldn't automatically be turfed out....Total 'Failed Business' Debt £29,043

I am a debt counsellor with the CCCS.
The first thing you need to do is change your bank account to a basic bank account with a bank you have no other connections with. This should break the cycle of charges and unauthorised overdrafts and help you get back in control of your money.
However if you are still living beyond your means changing banks in itself will not solve anything. I would suggest that, if you are struggling and feel like you are chasing your tail, that you either have a look at our online debt advice facility Debt Remedy available at www.cccs.co.uk or you could call our helpline 0800 138 1111 and book an appointment to talk to us, as there may be ways of managing your situation until you either have access to the money in the property or until the bank charges issue is resolved. Unfortunately the advice I can give you via this forum is limited.

Unfortunately, living with someone does not give them any rights as you may get with being married. It may depend on how long he has been with your mother and how much he has put towards the mortgage etc, but without any kind of written agreement, he is very vulnerable.
Would he be able to take out a mortgage on the house for half its equity value (or whatever you may see as being fair) so that he could buy you out? Or perhaps as the property was left to you, you could take over the paying of the mortgage and charge him rent. Possibly giving him a settlement of however much he has put into the house.
I am assuming he was a long term partner, with the above comments. If not, then you should really be taking over the mortgage repayments IMO.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

Just been out to work and had a quick look over your replies. Many thanks to you all.
I have decided to firstly open a new bank account with the A & L and hopefully that will get us out of the snow ball effect.
Think i'm gonna have to have a serious chat with my mums partner and discuss our options. I know he cannot buy me out as he is waiting for heart surgery, too unfit to work and lives off benefits. Dont know how i could sell the flat but keep him there with a tenancy agreement????????????
Also gonna have a look at doing the statement of affairs and see if i get anywhere with that.
