Creditor threatening stat demand for debt. I have asked for confirmation of the debt as what they were asking for was more than the original debt.

They hsve replied but the interest is extremely high that they have added and as t&c says only 3%above boe rate, it seems high. So i am disputing it again.

However, what are the time limits now im disputing a second time and how do i vetify my dispute.

  • You will need to apply to the Court for the Stat Demand to be set aside, you must make your application within fourteen days.
You must tell the Court what you are asking for and on what grounds.
However, disputing the interest rate applied may not be enough.
How much is the original debt for and do you have any grounds to dispute it ?
A creditor can petition for Bankruptcy for any amount over £5k.
An application to set aside can be very costly, if unsuccessful you could potentially face a costs order of up to £10k.
If you are willing to share a few more details of what the Stat Demand comprises it might be helpful for other forum members to give an opinion.
