Resignation before Christmas

Hi All,

Struggling to find a straight answer online.

I have accepted a new job offer which starts on the 2nd of January and I’m wondering when to hand my notice in. My notice period is 28 days as stated in contract.

Our work is due to break up on the 20th of December but I have a week booked off (agreed months ago) that entire week (16th - 20th)

We have to save 6 days over Christmas and I just want to make sure I get these somehow and don’t lose them, am I right in saying I should hand my notice in on the 1st of December?

Sorry if this is worded badly, hard to try and get all my points across.

    Id suggest speaking to your employer to ascertain the most suitable arrangements for you both.

    You dont say when youre leave year runs from, is it jan-dec? And is your holiday entitlement statutory or enhanced and if so, what is it?

    Year is January to December.

    We get 25 days plus bank holidays, we have to save 6 of these for Christmas.

    Worries that speaking to employer will make these extra weeks more awkward then they need to be if I can help it.

    Notice technically starts the day after it is given so count back the 28 days.

    Regarding holiday.....

    The employer must allow you to either use up your statutory holiday (28 days per year) before you leave or, if they insist you work all of your notice, they must pay you for any untaken holiday after you leave. Their choice.

    Any holiday over and above the statutory minimum (you say 25 +BH so you get 33 days in total) may be subject to contractual rules. You need to consult your contract / employee handbook etc to see if any special rules apply

    Thats fair enough, yeh you should be fine with those dates then.

    If your new job starts on 2 January, your last day of employment could be 1 January. To give them just 28 days (clear) notice, you would hand in your notice on 4 December, I think.

    The OP has a new job starting 2nd Jan, so 'most suitable arrangement for you both' doesn't really come into it. What the employer views as suitable to them won't necessarily be in the best interests of the employee. For example, the employer might ask them to resign earlier in order to save on wages. That definitely good for the employer but not the employee.
    Just hand notice in on the 4th, stating that you are giving 28 days notice as per contract.
