WHERE DO WE GO FROM HERE!Hi,

hi,
my husband and i already had financial problems and have been seeing a money advisor from CAB.......to cut a long story short she has near enough got all of our creditors to agree to reduced payments.
then..wham...husbands ex decided to go back to CSA and now £577 a month is being deducted from his wages a month.....obviously now to meet the arranged payments is going to be impossible.....advisor has said the only feisable thing to do is for her to contact creditors again and offer them all just £1 a month each.......theres no way their going to accept this....what the hell can we do....all but one of debts are in my name [ hubby had to declare himself bankrupt when ex left him, that was about 9yrs ago ] i can't even afford to go bankrupt even if i wanted to.....any advice?

    Hmmm ... this is a tricky one. Have you been onto the CSA website to do a calculation for yourself? Does his ex have accurate salary details?

    The best this to do would be to chat to a family solicitor/exec. With any luck there may be one on the forum! If not, I would phone a firm that has a Legal Aid franchise tomorrow for an informal chat - first thing to find out - where do you stand with Legal Aid? Once that is established you can then move forward.

    A sensible move would be to write to the CSA enclosing your SOA to see if they can be anymore flexible in the sum they have awarded to her. However, given how unorganised and slow they are it may be best to seek the advice of a solicitor first.

    Would agree with advice already given - you could also contact the CCCS and see what advice they offer with the debt being mainly in your name - they will take both incomes into consideration etc. this might help with the discussions with the CSA as well.

    I would contact CAB/CCCS/Payplan for advice and to see if they think it is feasible to get a debt management plan. If the CSA amount goes ahead then you will need to reduce expenditure to be able to manage. I don't think the CSA take into account all your debt when establishing money required by a child.

    CAB deal with CSA enquiries and may be able to help in the first instance and they are aware of your circumstances.
  • Huge hugs to you and your hubby, I know exactly how you feel, my hubby has to pay the csa for his kids.

    Don't get me wrong I know hubby has a responsibility to provide for his kids, what gets my goat is how the csa work out how much he has to pay, they don't take into account your outgoings or debts, they just base it on how much he earns, which is ridiculous.

    I would suggest chatting to your advisor about this and see what she thinks

  • £577 seems like an astonishing amount of money. How many kids is that for? Does it include some arrears? What is his income? Do you have kids living with you? The CSA works in mysterious ways from time to time and don't always get it right. They have a calculator on their website for you to work out your contributions. That just seems like a stupid amount.
