HELP PCN received but camera didn't catch us leaving!

We've received a PCN through the post this morning for overstaying at Asda's car park by 7 hours 56 minutes!

What actually happened was that my husband went in at 00:24 to get petrol on his way home from work. We then went to Asda store the following morning for a couple of bits, leaving at 10:20am.

The camera clearly hasn't picked up my husband leaving after filling up with fuel and us returning the following morning to do some shopping.

We have no way of proving any of this as far as I can see.

Complain to the ASDA manager (not Customer Services) and tell hi/her how absolutely ridiculous the times in and out are. Why on earth would your car be left at the store at an ungodly hour, then driven out 7+ ** hours later. What did they think you were possibly doing for that whole period.

If you're a regular customer take proof of patronage, like receipts and bank/cc statements. If you've an Asda credit card, take that too.

The manager will cancel this - he/she has access to the PE database from their desk.

    ** Although the times you've given suggest it's a 10 hours overstay?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you so much for that. I've spoken to the duty manager who has asked us to go into store with the receipts and they will cancel the notice.

Incidentally, she knew what I was going to say about us visiting the store twice that day before I said it

This is known as "double dipping", read some of these.

[FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
