  • It would be joint bankruptcy, as both of us are liable. We are have council tax arrears and gas and electric arrears but uptogether with repayment plans for these. No other debts besides the fees. The only difference in circumstances currently is my contract for work (self employed) was not renewed in September therefore we’ve used the savings we had to pay rent, bills etc. We’ve always maintained intentions to repay the debt hence offering the payment plan. They know we have no assets, they’ve asked previously for us to take out a loan to pay the fees off, but as I told them that would put us in financial difficulty with interest so now they’ve gone the statutory demand route.

    To make both of you bankrupt is going to cost them a lot of money, with no realistic chance of getting all their money. I suspect this is a bluff.

  • My thoughts are it’s to make an example of us to other parents who have fallen behind on payments. Which I understand, however it isn’t as though we’ve refused to pay we’ve been trying to offer a payment plan this entire time. Have they accepted back in April they would have had over £4000 now. 🤷🏻!♀️ Thank you all for your help though, really appreciate it.

    From this thread I’ll email them a final time the offer a payment plan again, if that’s refused then I’ll just wait for them to take the bankruptcy route I don’t think I need to respond for that option?

    You don't need to respond to them.

    I do wonder why you are not actually making the payments according to the offer you made. As you have paid them previously, you know the account number, so you could keep to your schedule.
