Council tax and attachment of earnings

Hi everyone

I have received my wage slip today and have had some Council Tax arrears taken from my wages - I knew it was going to happen but I didn't realise they would take so much (£423) which is nearly a third of my net wage.

They also took the payment in 2 seperate deductions, 1 @ £156.28 and 1 @ £266.75 = £423.03. Can they do that and is there a certain percentage they are allowed to take?

Any help is gratefully received.

    The Council inform the employer of teh total amount of the attachment but the actual % to take is set out by law and is calcualted by the employer.


    If the council have bene awarded two seperate Liability Orders they can combine them under one attachment or set them as two sperate attachments - if two are taken then the first one is calculated and then the second one is taken on the remainder.

    The employer should have calculated the deductions on your net wages , I deal with attachments evey day and the amount taken seem very high .

    If you earn £1200 net then the deds should have been - first one £144 and second one £126 = £270.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
