I don't know if this is the right place to post this, but I sent a letter to Red Debt Collections telling them I do not acknowledge any debt to them etc. etc. and this is the reply I got...

We are in receipt of your request for a copy of the executed credit agreement in accordance with Section 78 of the Consmer Credit Act 1974.
The agreement to which you seek is not a regulated consumer credit agrement and is not governed by the terms of the above Act,
Our client therefore has no obligation under the provisions of the Act to supply the information requested by you.
We would therefore request you contact us on the number below to put forward your proposals to settle the outstanding debt.

My query is. who is the original creditor? They say it is 1ST Credit. I have never got any loans or otherwise from 1ST Credit.
Surely I must get some idea of what this debt is for and how long ago this debt is.
Can someone plese give me some advice?

    Basically if you requested a copy of the CCA, they need to provide it unless it is for an overdraft. How old is the debt? If 6 years (5 in Scotland) then it will be statute barred.

    The letter you sent was absolutely right, and they have to provide the information. If they don't send you the information in 12 days they are in default, if you wait another 30 days after that and they don't send you the information then you can report them to various bodies.

    Also, if the debt is in dispute they cannot collect on it either. So if they try writing again, you can point that out to them.

    If you let us know what they reply, if they reply again, then we will be able to help you. There are template letters on here for every stage.

    Also, please let us know how old the debt is, because as George says, if its over six years or five in bonnie Scotland, its statue barred and you don't pay any of it. You cannot *un*statue bar it either.

    The 1974 act provides a number of Exempt agreements. That copy doesn’t seem to include amendments from the 2006 act, which brings some business agreements under the act, but redefines some exemptions in Sections 3 and 4.

    I’d want to know just what Red Debt Collections Services think they know. You could submit a Subject Access Request under the Data Protection Act. You can look at the Martin’s Template Letter relating to bank charges. You would be using the same right to know, but you’d not be asking about charges. You’d once again start off your letter saying that you do not acknowledge the debt and would ask for all and any information they hold that relates to you.

    I would expect Red Debt Collections Services to come back with something along lines that they can’t give you the information because they’re not sure you’re the person their records refer to. At this point, for obvious reasons, it becomes rather hard for them to carry on pestering you.
