Thanks
I talked to the agency but have just been told "its in the contract". I work for one of the largest law firms in the world which makes it even more bizarre that the agency are doing this (being on such a low wage). Also I've been at the job over 12 weeks and there has been no change in the pay/ I was under the impression that the wage had to match the job spec after this period ( Around 3-4K higher minimum).
I'm actually now looking in to starting a process to try change the employment laws in regards to agency workers, or get help at least. This is a disgusting business practice that needs to stop. If you accrue any holidays and can not take them then there's nothing stopping the Agency paying you this money, other than their own greed. They must have earned millions over the years from this.
Thanks for everyone's advice

Your work for an agency, not one of the world's largest law firms.
The 12 week thing gives you the same conditions as employed staff eg breaks.

If you work in such a law firm, do they have an Employment Law division? If they do, they would be able to tell you that there is indeed something stopping the agency paying you - the law: you need to take the holiday in order to be paid - or leave the job and get accrued holiday pay in your final pay.
Agency workers with the requisite time in the role are entitled to some of the same terms as directly employed staff. That does include pay but that is the pay of someone comparable working in that company and not some hypothetical figure attached to what you think is your job description.0 -
The job is done no a general admin job, its a specialized job and is not advertised as minimum wage anywhere.0

I talked to the agency but have just been told "its in the contract". Is it - have you checked? I work for one of the largest law firms in the world which makes it even more bizarre that the agency are doing this (being on such a low wage). Also I've been at the job over 12 weeks and there has been no change in the pay/ I was under the impression impressions count for absolutely nothing. What have you got in writing? that the wage had to match the job spec after this period ( Around 3-4K higher minimum).
I'm actually now looking in to starting a process to try change the employment laws in regards to agency workers, or get help at least. This is a disgusting business practice that needs to stop. You mean where agencies stick to the terms of the contract workers have signed up to?If you accrue any holidays and can not take them then there's nothing stopping the Agency paying you this money, other than their own greed. Yes there is; legislation! They must have earned millions over the years from this.
Please see above comments. Also worth reading https://www.acas.org.uk/article/6493/Rights-while-working-as-an-agency-worker - and possibly worth drawing its contents to the attention of your agency, just in case they are willing to chance their stance.Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0
