Council tax and bankruptcy

Hi all

I am about to submit my bankruptcy petition. I am behind my council tax debts by six months. If I go bankrupt, will the council chase my husband for the payments ? The property belongs to me.

    Does your husband live in the house with you? If so you are jointly and severally liable, so the council can chase either of you for the arrears. If he does not live with you and is not on the CT bill, he is not liable.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Council Tax is included in bankruptcy for you but as Lincroft has mentioned this does not extinguish the debt against another party who is jointly liable - it effectively shifts the responsibility on to them to continue paying as the council cannot enforce payment against you as a bankrupt.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
