Havs claim

Hi I was looking for advice about my HAVS claim, I am 28 years old and worked for my employer for 8 years as a roofer, I done a 4 year apprenticeship and 4 years out my time, my lawyer has issued a a claim for HAVS I’ve yet to hear back but they’ve got until mid November, in the 8 years I was there I had only been on 1 awareness course and tht was in my 5th year after my apprenticeship where in my opinion that’s when the damage was done as I wasn’t made aware of it as I was still learning the trade, I have extreme affects of it for my age, every finger and my thumbs turn white the full length of every finger wenever the exposed to vibration,cold or damp conditions, I have actually left my job because of the condition and need to start a new career all over again due to the condition, I worked for a government organisation so they should have took more care than say it was a independent company, I was just wondering if anyone knew how long the claim would take to go through and best way to deal with offers etc I might be offered also roughly how much I would be expecting to be offered as I I’ve never been down this route before, I would really appreciate any advice at all anybody could give my on this matter thanks

    That's exactly what your solicitor is there to advise on - there are huge variations in cases which have an impact on whether the claim succeeds at all, how severe the damage/disability is and how long the whole process takes.

    Your previous posts said that you were dismissed and you complained in them that following appeal they hadn't given you your job back? Which is it? Did you consult your lawyer about the efficacy of claiming unfair dismissal? Such matters are not unconnected.

    If it was an independent company then you didn't work for a government organisation. The company may have had contracts with government agencies, but that does not make the government liable for your alleged I injury.
  • I have left due to the unfair dismal case that I won, the reason I got put onto tht was because I was on sick for so long with the HAVS condition and it was a the a direct contract with s government orginisation

    But that is why you have a solicitor, and that is who you should be talking to. We know nothing about your circumstances and the information you are giving is contradictory. You say you had a contract with the government department directly, but that they say you worked for an independent company. We can't sort out that contradiction. We don't know anything about it. You need to be speaking to your lawyer.
