Following on from my original post I have received communication from my ex partner’s solicitors trebling the original offer. They have though deducted money for me not having contributed to the mortgage for the last 10 months. Is this fair and/or legal? My ex hasn’t contributed to my rent for the last 10 months either.
Have they given you a calculation of how they have arrived at this figure?
You have not contributed to the mortgage for the past 10mths but likewise you have not charged your ex rent for occupying your share of the house for the past 10mths.0 -

Yes they have given me a calculation for how they have arrived at this figure which starts at £24k but then deducts £6k because they say I agreed to put in £6k when the house was bought but didn't (I never said this by the way, I didn't have £6k). Then deducted £3,500 for the last 10 months mortgage payments.0 -

Your rent payments are a fair comment. Ask your solicitor to respond on this basis. With your own settlement figure. There'll be a compromise to be had by the sounds of it.0 -
Another alternative is you value the house at the time you stopped contributing 10 months ago and calculate the 20% based on that valuation and outstanding mortgage at that time.
Did you contribute towards the time share?
Are you still getting use from it?
AS you are still an owner of the house have you looked at moving back in?
Sometime that option focuses the OH to reconsider their offers.0 -
