ATOL Rules & 'Cover'?

Can't see anything on here to answer this so going to ask here.
So, I booked a holiday through loveholidays in July for October. One of the flights was with Thomas Cook who sadly have passed!
Luckily love holidays have rebooked another flight for me on the same day so the holiday is going ahead but as I scanned the new flight summary I noticed that no baggage allowance has been booked.
I have today called LH and they tell me that they are only 'bound' to book a flight under ATOL rules and i'll need to go to the new flight operator and book luggage and pay with them.
I've already paid for this in with the original package deal so not sure if LH should be refunding me?

I do not know the answer to your question but the fact that they have managed to save your holiday with replacement flights is a godsend,i would be tempted to pay for the luggage and at least get a holiday,many people have not been as lucky.

Did you book and pay for luggage with Loveholidays at the time of booking? If you did then I would push Loveholidays to book luggage for you. Sounds like they are trying it on. I would expect any replacement to be like for like. This might be covered by the Package Travel Regulations 2018, so it might be worth a read. ABTA might be able to help you also.

If you didn't book and pay for luggage as part of your Loveholidays booking (i.e. you booked it afterwards directly with Thomas Cook) then loveholidays will be off the hook.

Yes, all booked at the same time. Thanks for advice, I shall check out the Regs you suggested.
