Hello, I am in serious debt (£56k + Mortgage) I have recently got my head out of sand and making an effort to understand an get to grips with debt.

When I wrote everything down I nearly had a heart attack. I put together a letter to all my creditors asking them to write-off my debt as at the time I didn't think things could get better, the obvious thing happened, they started ringing up and saying cannot write-off debt. Which I expected to be honest.

So my next step was to work out pro-rata payments, I have now got 3 of the 18 to agree to these pro-rata payments - which is a great help, and a 4th has agreed in principle I just need to provide them with a breakdown.

BUT Today I had a phone call from the NATWEST and ended up hanging up and was in tears and quite frankly think their tacticks are dreadful and almost like bullying.

I would add that I have had some good news this week in that I have got a new job which will start in January so I will be in a better position then, however don't know any figures I am on a basic salary with various shift allowances, however I will need to put my 3 children into childcare and morning/ afternoon clubs on various shifts so until I start it will be difficult to work out what I will get, cannot notify the Tax Credit people until a week before, so don't know what I will be getting from them.

Anyway - Natwest called regarding debt on my account. I offered to pay £20 for 1 account and £5 for the other one. They said this was unacceptable and they can only accept £45 & 22. They said I was being unco-operative and would not tell them my income for January. I explained I do not know what I will be able to pay as I do not know what I will have available. They would not accept the payments I have offered. And said they have no choice but to default my account because I was "not prepared to make an arrangement based on my income in January"

Can someone please tell me my rights - I thought as along as I offered to make an offer of payment, no matter how small then I was OK. I am only £21.62 Over on one account and £138.45 on the other account. I would have thought that the offer I made was reasonable (These figures are based on the amout I am over my agreed overdraft Limit)

I have every intention of paying off my debts and was going to get my salary paid into one of these accounts which means I would be within my agreed overdraft following my first full salary payment.

Please can anyone help me. I am desperate. :mad:

    Hey there

    You need to contact one of the organisations in my signature. They can help you work out what oyu can afford and should be able to get it approved by creditors for you. They can also offer you emotional support.

    Thank you to silvercharming, I have used the websites you suggested to work out pro-rata payments, and used others to check my rights.

    After calming down and checking a few things out on these sites I called the bank back - and remining calm and after 55mins on the phone managed to get them to agree to my terms in the end. However I had to make them aware I knew my rights and would be making a seriour complaint to the FSA and trading standards about their treatment and threatening behaviour. I spoke to a manager in the end as the advisor on the line just kept quoting policies and we have done all we can.

    When I spoke to the manager I asked him to explain why they are my only creditor who will not agree to a pro-rata payment, when The Royal Bank Of Scotland had already done so - surely they have the same policies. At this point in the conversation they suddenly decided they could help Me.

    Just shows that if you do your homework before you speak to someone and stick to your guns they will eventually realise that they have an obligation to help you when you are offering to re-pay a debt.

    Hopefully I won;t have any probs with them again.

    Well done, it is important now to keep to the agreement or they will come down hard. If they start giving you problems please consider Payplan or CCCS who can fight them on your behalf.

    It's a long way to go but once your started you will be surprised how the figures fall.
