What forms? Just spoke to OR

Hi I have just had meeting over the phone regarding my bankruptcy.

I filled it in online and paid.

The lady said she is sending something that needs signature of a witness.

What are these forms?

I’m panicking and had a lot going around my head!

    Relax, its most likely just a statement of affairs you need to fill in, this form asks you to list all your assets (anything that belongs to you that may be used to pay your debts) and all your debts, including the names and addresses of the creditors and the amount you owe each one.

    When you have completed this form you will be asked to make a sworn statement as to its accuracy before an officer of the court or a solicitor - it is vital you make a full disclosure of your assets and debts.

    It’s standard procedure and nothing to worry about.

    Hi, just checked through my paperwork. There is a few forms that they send you to sign and return. The one that has to be signed by a whitness is form NTB2. It's nothing scary, just a form to say you've declared bankrupt, your details are..., I understand these restrictions apply while I'm bankrupt... etc...

  • Thank you. She started to say we could pay towards amount each month but then we realised we entered things wrong and missed bits out.

    The lady was lovely and said she will send some forms that need signing and nothing much after that.

    She said she won’t need to speak/see us again at this moment in time.

    That’s why I’m stressing!
  • thevdm is correct, it’s the NTB2 which needs to be witnessed. This form is where you sign to say that you have read and understand the restrictions that a bankrupt is under. If a bankrupt does break any of the restrictions then they have committed a criminal offence, so this document means they can’t use a defence of not knowing.

    The link is a bit out of date as there is also a DPADA which is your letter of authority allowing the OR to obtain your personal data from external organisations for their investigations. The legislation actually allows the OR to do this anyway, but it makes it easier.

    I didn't spot the missing data protection form on that site, although I do have a copy of it in my paperwork so have filled one in.



    All the paperwork they send out is to be read and signed, there's no additional forms to get your head around (unless of course you'll be paying an IPA, I'm not sure what exta is required for that). The phone call you've just had would be the last point of contact I had with the OR in my case. That was back in February and unless my circumstances change before next February I doub't I will hear from them again.
    I may be wrong sometimes, I learn a little every time I'm corrected.
