    I WON!!
I spent this afternoon in Workington County Court with others who HX has continued to pursue and despite each of our cases being different and a representative from Gladstones being there we were all successful in having the cases against us dismissed.
The judge was brill - he had obviously spent time reading each case and was able to pick up on points of law which meant I sat back in admiration listening to someone impartial with a sense of fairness.
I cannot thank Sue Prior enough - she has been an absolute brick and without her input I would have really struggled to present my case or keep relatively positive throughout the year this has taken.
To those who came today to support, thank you - Barry - in particular you helped tremendously.
If anyone has any worries, use Lynda Eagan or Sue, they are marvels.
If anyone wants help with what will happen at court please private message me and I will do my best to explain.
I will also try and support anyone who wants help on court day but would need to know when that was. It was so helpful today to have my side full and the other with just one lone representative from Gladstones - thank you.
KEEP GOING those of you who are on the road I have been on, unless we do so, HX will win and we can’t have that can we - up the Cumbrians!!!!

  • Hi Everyone.
Thanks for the advice on this thread so far. Congratulations to fil cad on the win!

I’m still going through the motions but have followed the advice thus far as closely as I can (trying to pick through the bits relevant to my case on the Newbies thread is the biggest challenge, but the content is remarkably helpful once you figure it out).

I’m generally feeling pretty relaxed about the whole thing with a defense submitted in time, and in good detail, following some of the examples and a similar case on the Newbies Thread.

I just need some advice on the next step. Gladstones have come back to me with a directions questionnaire where they have asked for mediation. As advised on the Newbies thread, I’m going to decline this as I want to resolve this in court.

However, if Gladstones are requesting mediation, is this a sign that they are feeling like this case will not be successfully fought in court or just standard protocol for them to follow?

    Many Thanks

Absolutely standard roboclaim procedure - read nothing into at this stage.

You will need to deal with your own DQ when received from the court (or download your own from the internet).

Gladstones actually sent over a directions questionnaire. Do i ignore this and wait for one to come from the court?

That will be their DQ, you need a blank one.

I had my court hearing for this case over video link a few days ago and won! 🎉🎉. The claimant decided not to attend and submitted papers in their place. It didn't take long to come to a conclusion and the case was dismissed.
Fantastic result against this trigger-happy litigant. Very well done, and a nice endorsement from the Judge of the quality of advice and resources emanating from the forum. 🥂

Could you tell us what the basis of the Judge's decision was please?
