6 Years Past & CCA

I would appreciate help with my situation. I have had a payment plan in place for over 6 years to Barclays, Capital One, MBNA & Halifax not huge amounts but they have been passed collections onto and consolidated into the following DCAs, Link Financial, Cabot & Moorecraft.

Although I am paying monthly, the weight of these companies is still hanging over me. Link financial have asked for me to complete a budget form again and they have sent some threats. I want to be done with it all once and for all so I want to take action.

A family member has offered to help out and I was thinking of sending for a settlement offer (well one of them for now) but considering to request CCAs and taking it from there.

As my credit file is finally clear after 6 years. Can it still be affected by any of the DCAs?

Link Financial has now stopped my payment due to the above and has stated “ ..the review period has now ended and the arrangement has been canceled. The account is now subject to our normal collection’s process”. I have still continued paying every month as per usual despite their statement.

One more thing! From the outset of the payment plan, I have been sending the payments electronically to the original lenders (Above), who have been ‘passing’ these monthly payments to the DCAs (as far as I know). Due to pursing a request for CCAs, is this not somewhat fruitless? Or does this matter?

    Why are you not paying the DCA’s directly ?

    Original creditors have sold (most of) the debts, they no longer have any interest in them, except the moorcroft debt, they don’t buy debts, they just act for their clients.
    CCA requests are standard procedure before making settlement offers, make sure everything is conducted in writing.

    Everything was set up originally by the CAB to the original creditors and have passed hands. I did receive letters of changing hands and to be honest my life has been a rollercoaster and I just kept making the payments as usual without any issues from the DCAs. Foolish on my part? Does this matter? It does seem to be a bit strange now that I think about it. Link Financial did say that they have not received payments only recently but they came back saying their mistake and that I can continue as usual or pay them directly.

    My other question regarding my credit file, as it is finally clear after 6 years. Can it still be affected by any of the DCAs in any shape or form?

    Hi,

    If all the accounts have been removed from your three credit files, then that is permanent. The accounts cannot suddenly reappear on your three files. They are gone for good.

    As sourcrates has said, doing the CCA is standard procedure. I recommend using the National Debtline letter template linked below:

    The settlement offers should all be sent to the DCAs (as should all other correspondence).
