Where's my early discharge??

Hi all

OH and i went BR in April with similar debts on the same day. All our paperwork has come through at the same time but OH got his early discharge letter yesterday but mine's nowhere in sight! How long are the BR notices in court for waiting to be finalised? Are they done on a daily basis? Or are they dealt with on a certain day of the week? I just wish it was all over for us so we could start over again! Thanks, i hope you can help!

Hi Lucy,
have you checked the insolvency website.. http://www.insolvency.gov.uk/eiir/ you may have been discharged but they haven't been informed you yet.
Some people find there on the website, but still wait weeks for their letter from OR.

Yes i have just looked this morning and i'm still bankrupt, so don't know what's happening there? Just wondered if the courts deal with BR discharges on a certain day of the week and is the discharged filed in court a week before? Not sure how it goes. Cheers for your help.

I would guess they have a pile of folders and if they have a quiet 5 minutes they will deal with the ED's. If your husband's file was further up the pile than yours then he got done.

There is no automatic right to early discharge either and it may be that depending on how the debts were in your cases, your OH could quite easily get an early discharge and you not, especially if its like a 50/50 split in debts but he's earning and you aren't.

Yours was probably just in another 'pile' waiting to be 'rubberstamped', lucy, - I would doubt very much that you were being treated any differently to your OH.
It's just another indicator as to how busy the courts are, so, fingers crossed for you - hope it arrives soon.

OH and i went bankrupt october last year on the same day, i was discharged 6 months early, we waited and waited to see if OH got a letter, but he never got one, they waited till the 12 months was up and was automatically discharged then. so it may well be that you won't get an early discharge. we were both out of work at the time so i guess they thought they'd wait or OH in case he got a job so they could put an income payment order on him. each case is dealt with on it's own merit i suppose. hang on in there, it'll be here before you know it.

Why would you assume that you were also entitled to "early discharge"? Maybe yours will take the full year, which isn't really that long considering how much it will change your situation for the better, is it? I think your OH just got lucky;)

Hi Lucy,

There's no guarantee of an ED, I'm afraid, so unless you've both had ED paperwork it may be that only one of you is getting it. Even when both parties go BR, it's possible for one to be given an ED & the other not - it happened to Bakeybadoo. I suspect it would be in some ORs' interests to only grant ED to one of the parties rather than both, as that gives them the year to impose an IPA if they want to should the circumstances of the household change. You never know though, you may still get it - there's just no way of predicting what the OR will do on this.
