Self employed bricky, not paid

The reason i mention defective work, is that ultimately not to pay me, would be the only way he can justify it, and as a self employed bricklayer of 25 years or more, i know is the only way brickwork subcontractors or indeed developers (ie persimmons for example) can and will sometimes use as an excuse to get out of paying the tradesman, often for his (or her) last weeks work.
The reason i mention 20% deduction, this is how it works for site work (not domestic ie a local builder), we are deducted 20% of our earnings, which is then payed to hmrc, and weighed against our liability come the end of the tax year when we due our tax return.
In terms of other bricklayers, as i say i was in a gang.
Me and the other bricky had our differances, what happened is he went on sick, i did 3 or 4 days on my own with the labourer, the day before i was due to go on holiday for a week he came in and took his tools and the labourer to a different job for the same brickwork subcontractor. (Yes it was very kind of him but hey ho)
So bar these few days on my own any "defective" work would be both mine and his and we would both be liable to correct it . Fwiw for reasons that would be too long to go into there is no way any work i undertook on my own could be defective.
Also dont misunderstand my mentioning of defective work, i am just preempting what i know would be the only excuse (which would be a lie) to justify non payment0 -

No i did not walk off site
I was going on holiday, and talked with the brickwork subcontractor on my last day after the other bricky did what he did. I wss supposed to be coming back after my holiday with another labourer
But when i returned from holiday on the Friday before i was due to start back on thd monday (which was also the day i was due paying fwiw), i tried to ring him etc etc, and basically he ignored my calls and txts and has done since0 -
Get somebody else who he doesn't know (or even somebody who does..) to phone him and then get the phoned passed over..
From what I understand from a friend and neighbour whose brother runs a brickie gang it seems quite common for main contractors to get out of paying, particularly towards the end of a building phase.
Of course, if he claims defective work you could always go back and rectify, with a sledge hammer..0 -
