Employees in the same job working different hours for the same pay

Hi there

I work for a large company and have discovered that my exact job role at differing sites with exactly the same pay have different “full time” hours.

So in one site a full time role is 32.5h per week and at other sites including mine the full time role is 37.5h per week, all for identical jobs with identical pay. This isn’t anything to do with London weighting or areas etc - it’s completely random.

Does anybody know if this is legal?

  • Yes its legal. They could pay someone your wage to do nothing if they wanted to.
  • I thought there was some kind of equal pay for equal work legislation? Does that not cover this?

    Nope, they're just not allowed to pay people different rates because of protected characteristics such as sex, gender etc
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    Nah I have employees who do the same role some do it far better than others should I pay them all the same nah......
    Its Vegas time -no longer :T a five year old has changed Vegas time to Orlando time

    Yes it's legal.

    You can 2 identical jobs and pay completely different salaries.

    You could pay a part timer the same as a full timer for considerably less hours.

    Negotiate the salary you want and forget about anyone else. If you are happy with your hours and pay it doesn't matter what others negotiate.

    For the record it’s an academy chain and we are all teachers. The academy is really bad with payroll - promising the govt recommended pay rise but taking months to implement it (months of being chased), “accidentally” forgetting to put your pension contributions into the pension etc etc. So I don’t have a lot of trust in the company.

    There is indeed such legislation. There would only be an issue if people had different 'full time' hours (and thus salary) based on gender, religion or some other characteristic which would constitute unlawful discrimination. Otherwise the employer's take on 'full time' can be whatever it likes.

    This prevents employers paying different amounts based on protected characteristics - so if all (or the majority) of the people getting paid to work 32 hours were men and all (or most) those getting paid the same amount (so a lower hourly rate) were women, or vice versa, then this would, assiming that the jobs really are the same, be unlawful.

    However, unless the reason for the diference is discriminatory, there is nothing to prevent employers paying different wages for simi;ar / the same jobs.

    It is of course also possible that there are reasons you are not aware of - people may have slightly different holiday or sickness entitlments, or be on older contracts, for instance.
