Signed IPA but had no further contact

Hi,
I was made Bankrupt on June 12th 2019, had phone call with OR, supplied all info. Then had an IVA letter saying that they would be requesting my council tax and applying a NT tax code. I signed this and sent it back but haven't heard anything since about when or how to pay these things?

The NT code hasn't been applied yet (just had my August pay with the normal tax code) and I also don't know if I should've been saving the council tax each month to pay back when I am given more information?

I'm a bit confused. Should I be worried?

I've contacted the OR but not heard anything.

You should have had contact by now. The prudent thing to do would be to not spend the extra money from you tax and council tax holiday as the likelihood is that you’ll be asked for it.

Not unusual at the minute with most OR's office workloads.....

  • I've not been waiting as long as you but curious myself too.

Have the council been in touch with you out of interest?

The income tax isn't a problem, as long as its being deducted at source as usual. The OR will claim that back from HMRC. If the NT code is applied and you still haven't heard from the OR - then keep any money you would have paid as tax set aside. If your IPA made specific mention of the Council Tax then you must put it aside safely and wait for contact about its collection.

Other than that - as you have already contacted the OR - leave things alone, only speak when spoken too and don't 'poke the bear'. Just sit tight and wait for them to contact you. It is not your responsibility to chase the OR. Carry on with life with your fresh financial start - concentrate on the future and managing your money impeccably.

It sounds like the OR is still pondering what to do after the 'volunteering an amount' thing.

Thanks all. Council got in touch initially as I had not included it in my bankruptcy as didn't think I could. They said they needed a letter from the OR which I arranged and haven't heard anything from the council since.

Thanks for the advice regarding the contact. I have email proof that I've been in contact and am waiting to hear back so should be easy enough to prove.

Think the NT code will be applied from this month from the looks of it. Will it be deducted at source or do I need to save it and pay it to the OR when they finally get in touch?

When an NT code is applied - you effectively pay no tax at source so you will get all the money you would have paid in tax in your salary. You must put aside what you would have paid in tax and wait for the OR / their agent (usually Carke Willmott) to get in touch regarding its collection.
