Company Director after bankruptcy discharge but paying monthly payments

Hi and thanks for any advice in advance.

I was declared bankrupt (sequestration here in Scotland) in 2017 and discharged by the AIB in 2018. I do however still make monthly payments to a trustee and will for another 2 years. Do I still have restrictions on setting up a Ltd company and becoming a director and also do I have any other restrictions. When I called the trustee to ask these questions they could not answer them and told me to call companies house. I would like to know where I stand before making any decisions.

  • As long as you are not subject to a bankruptcy restrictions order or undertaking then your restrictions on acting as a company director are lifted as soon as you are discharged.
  • Hi, thanks for your response. That’s good news. The trustee( very large company) couldn’t tell me that after speaking with them twice as they said that I would not be discharged from them as I’m paying the monthly payments even though I’m discharged from the AIB. Many thanks again
