Parking eye ticket

Hello everyone,
After reading different post here on how parking eye have been able to take people to court , I decided it will be good to seek advice.
I went to a retail park , there are no paying machine there and can park for 3 hours , I use to be a member of this gym for years but recently moved out of the city and the car park use to be free all the time . Fast forward I came to the gym last month and bought a DAY PASS to train as I wanted to use the opportunity to train with friends that I haven't seen for a while , I honestly forgot that the car park is no longer free as it use to be and overstayed by 22 minutes , a week later I received a letter from parking eye for breach of contract for £100 or £ 60 if paid by 14 days , I can understand I made a mistake but I have appealed and sent them the copy and receipt of my gym Day pass and that my car overheated , and I could not have physically move the car out of the car park and isn't it unfair? that they are charging me £100 even though I wasn't trespassing, I actually parked at this retail park because I bought a gym ticket that is for a day ,so don't see how I constituted a lost to the land owner and this was on a sunday morning . But they rejected it , and have given me reference number to appeal to POPLA , do I stand a chance to appeal again or just pay .

Without missing the POPLA deadline, email a landowner complaint to the gym manager ASAP. Include a strong request for the email address of the landowner if the gym is not responsible for the land on which the car park stands. In your complaint, absolutely insist that the PCN be cancelled, landowners do have the authority to do this.
Was the driver identified in the appeal to Parking Eye? I take it this was not a windscreen ticket .... is that so? When was the parking event and when was the NTK received?0 -
the pcn is for breach of contract , nothing to do with affecting the landowner or anything

No such item as registered owner , there is no database of owners requiring registration

Just a point of order, there is no register of vehicle owners, only keepers.
This being the case, you should edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper, who are two different people.

I have spoken to the gym , apparently the manager cannot cancel or request cancellation for this ticket, they don't know the landowner either . My argument is I paid a day PASS to use the gym for the day and park there , no ticket machine on this car park to pay either ,since this ticket is all for breach of contract, I'm thinking of waiting for them to take me to court and I can argue my case .0

Nine times out of ten these tickets are scams so consider complaining to your MP.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.You never know how far you can go until you go too far.0 -
