HMRC Data Breach...can we claim damages?

Under the Data Protection Act you may claim damages if your rights have been violated.
Unfortunately how do you prove that those damages were a direct result of those 2 missing CD's? The sad truth is that if those discs fall into the wrong hands they will be copied and sold off to a host of different black market buyers - all intent on using that information for their own purposes. So therefore it would be hard to prove where that information came from.
Statistical chance of claiming damages from Data Protection Breach by HMRC? 1 in a million.
I know if I had those discs I would have made a few hundred copies already and kept some of them in safety deposit boxes around the country. Those discs are probably the most valuable discs in the entire world right now.
They wont be found - people will kill and be killed to get their hands on them and you will have no chance of proving that the damages that you will incur as a result of HMRC's negligence was caused by them in the first place.

In law you are under a duty to minimise any losses you suffer due to somebody elses act. (E.g. your boss unfairly sacks you, you should be looking for another job to minimise your losses and if you don't it will effect any payout you win)
Why is that relevant here? Well if you take action now you can minimise any loss you will potentially suffer. Therefore you should close your bank account and open a new one (I am going to), take a subscription out to a credit monitoring service and invoice HMRC for the cost, anything else you think you need to do.
Women / Men that have fled from abusing partners should now consider moving (as their new address has been comprimised) and HMRC should pick up the bill.
I look forward to receiving my letter from HMRC that I expect will be telling me the actions I need to take.0 -
