Hi all
I remortgage in 2004 through a company called AWD they Said i would need to put all my credit card debt on my mortgage and any loans to be accepted for the remortgage which i did, and in 2007 they came back to review the mortgage and said i could remortgage for a better deal again they said i needed to put all my credit card debt on my mortgage and any loans to be accepted for the remortgage i said i didn't want to add them as i could afford to pay them separately but he said we would not get accepted if we did not .Is this misseling,if so what could i claim back

AWD are they mortgage brokers or are they the mortgage provider?Just because I disagree with you, doesn't mean I hate you. We need to understand this as a Society

AWD were Brokers and morphed into Carrington Carr and went into administration in 2010.
Article about them here:-

When in 2004? Mortgages only became regulated in October 2004. The date of application being the date that matters. Not the date that it was advanced.Said i would need to put all my credit card debt on my mortgage and any loans to be accepted for the remortgage which i did, and in 2007 they came back to review the mortgage and said i could remortgage for a better deal again they said i needed to put all my credit card debt on my mortgage and any loans to be accepted for the remortgage
What is the problem with that?i said i didn't want to add them as i could afford to pay them separately but he said we would not get accepted if we did not .Is this misseling
Why would telling you that and you saying you didnt want to a problem? Is this misseling,if so what could i claim back
Insufficient information to go on. If you bought before October 2004 then it certainly wont be as it would be pre-regulation.0 -
If the company has went into administration I don't think the OP can claim against anyone. And I've not heard of mis-selling mortgages. Granted the OP re-mortgaged during the hey-day before the financial crash (and we all know how that ended up). It'll be interesting to see if anyone claims for mis-selling mortgages, I know I'd be in the queue for Northern Rock.Just because I disagree with you, doesn't mean I hate you. Its not common and the vast majority of complaints fail. However, a small number of CMCs are trying to make it the next PPI issue as they hunt for ways to replace their lost PPI cuts.0 -
the second remotrgage was with a new lender in 2007 the credit card and loan debt would of been paid off by 2009, i have 4 years left on my 2007 mortgage ending 2023 so i would of paid a lot more interest on the credit card and loan debt just so a broker can get more commission0

Hi, I noticed your comment about missed mortgages...Its just starting....google Michael Benecia...Michael won a landmark case in the High Court....now case law..He's setting up a class action against the banks....very soon...apparently 1.000's have signed up already.

Mortgage commission is around 0.2%. So, £3000 of credit card debt would add about £6.
Debt consolidation onto cheaper debts can be sensible. And if you felt you can afford to continue paying a higher amount then why didnt you do it via the mortgage in an overpayment?
There is nothing wrong with debt consolidation as long as the rates are cheaper and the risk warning appears in the closure letter (on post Oct 2004 cases).Hi, I noticed your comment about missed mortgages...Its just starting....google Michael Benecia...Michael won a landmark case in the High Court....now case law..He's setting up a class action against the banks....very soon...apparently 1.000's have signed up already.
An extreme case that doesnt match the scenario of hardly anyone.
The FSCS and FOS have both complained about CMCs putting in try it on complaints with mortgages and told them to stop doing it.0 -

You mean this?
https://www.thebernician.net/historic-judgment-which-changed-everything-for-uk-mortgagors/
Whatever else transpires from here, a binding precedent has now been set, which no county court judge will be able to ignore without getting hammered on appeal, by all but the most determined liars, cowards and fools who have sworn allegiance to an entirely illegitimate monarchy, ruthlessly controlled and exploited by the Crown House of Rothschild for private gain.

Oddly enough Which? has a template letter to complain about a mis-sold mortgage and cites one complaint reason as;
When remortgaging to consolidate my debts, I was not advised that it would be cheaper for me to put all of my loans, credit cards and finance onto my existing mortgage rather than remortgaging.
