    ACAS does not have jurisdiction to make a decision on this. The employer does not have to wait for the ACAS process.

    The Employment Tribunal doesn't have jurisdiction to hear claims by employers against employees either.

    If there is a dispute, it will have to go through court.

    If you believe that you have a strong defence to the employer's claim, you will just have to enter a "defence" if the employer does decide to issue proceedings.
