Thames Credit - Statute barred response

  • My wife is having Hassle from Thames Credit and I have searched for advice - that has lead me here.

    Can someone please advise why you send them a £1 postal order?

    Since they refuse to acknowledge our first letter & phonecall in their second letter, I am sending a second letter below. Can anyone offer advice on this? The debt is from over 5 years ago. We live in Scotland - so does anyone know the law on Statute Barred debt in Scotland - and finally - would Thames Credit admit it was Statute Barred?



    ******************LETTER*********************

    Thank you for your letter dated **/**/2008. For information, this was postmarked **/**/08 from the post office in Bromley, Kent, so I apologise for the apparent delay in the response to the letter.

    The flat number has been missed off previous correspondence, so to help ensure that any further correspondence is received it might be helpful if Thames Credit could please update their address records to show that above.

    I replied immediately to the previous correspondence by telephone and letter and asked for you to provide evidence of the credit agreement that is apparently outstanding. In the letter dated **.**.08 you state that you have not had correspondence, so without further ado, all future correspondence will now be sent through registered post so there is no dubiety as to what has and has not been received. I also ask that all correspondence from Thames Credit be in printed form to the address above.

    As soon as Thames Credit Limited provides me with the evidence of this agreement, along with proof that this debt is still collectable, I will seek to clear the debt immediately. Until such time evidence is provided I refuse to recognise or acknowledge this debt.

    If Thames Credit could please provide the original credit agreement along with all information relating to this account as soon as possible then I can bring this matter to a close.

    Statue barred laws in scotland are after 5 years of no payment or no acknowledgment of debt in writting.

    AFAIK The £1 postal order is the amount laid out in legislation that is the maximum amount a company can charge for a copy of a CCA.

    I suggest you search for CCA requests on this board and also on the national debtline website (selecting scotland) for information on how to officiall request your CCA and what happens when they don't supply it.

    £1 postal order are sent if you are making a request for a Comsumer Credit Agreement.

    If you are claiming that a debt is statute barred (5 years in Scotland not 6 as in E&W) then you should not be sending anything other than the statute barred letter.

    What did you send the first time?

    Be careful if the six years is coming up . Some companies have taken the £1 sent with a CCA REQUEST and claimed its is towards the debt . This is done in the hope they can claim a payment recognising the debt within the six year deadline .
