  • Sound like the OR is hoping for a surplus when you move BUT that's not going to be until after the 12 month anniversary of your BR - at which point they can't set one up - it has to be done before you are discharged.

    Unfortunately the rent agreement was signed in June this year. I would imagine that the OR will likely try to get me to move, reduce my costs to allow a larger IPA to take place in the months between June and August.

    Don't be signing no small IPA! Anything less than £100 should not be agreed (and the OR is unlikely to take you to court for that amount).

    So if you don't agree to an IPA (Income Payment Agreement) the OR can ask the court for an IPO (Income Payment Order).

    It would be up to the court to decide whether you have a surplus, the OR would be submitting an argument as to why they think there is one

    This is manly used when the bankrupt person is not cooperating with the OR, or if they simply cannot agree
  • Just looking at your figures, and (without suggesting in any way that you should be trying to cut your bills down, in fact put in an emergency fund) I just want to check that you haven't included arrears in your gas, electric or water, and that you are getting your single person discount on the council tax?

    75 a month for medical - this might require some justification. The OR will be expecting this to cover NHS dentist, prescriptions and glasses, for many £20 a month would suffice

    Looks like there is scope to economise on the tv/telecoms bills, although of course if your in contract thats not so easy
  • I thought that if they were asking for voluntary amounts it is possible that the end result could be zero payments.

    I haven’t been disagreeing with their questions just that I don’t feel I can realistically commit to a payment plan. That being said if they told me a figure that they want me to pay I would do my utmost to agree and put it to bed.

    Not sure which way to turn.

    No areas those are the figures set up when I moved in. In hindsight I have over egged some and under egged others. Emergency fund as an example.

    Yeah the total figure came from prescription and medicines, opticians and density. Seems a lot I agree.
