Where Do I Start?

I dont quite know where to begin but here goes. Approx 7 years ago, my husband bought a black cab to drive as a taxi. All went well for a few years until he ran into debt(wasnt making enough money etc) To cut a long story short, it was reposessed and the vehicle was sold for alot less. Hence he was asked to make up the shortfall.(£10,000):eek: The end result then was that a judgement was made that he should pay £40 pay a month. He has now defaulted on this as he has nil income except the income based jobseekers allowance. We also moved this year and today he has received a letter saying that our local court is dealing with the "enforcement".
I believe that bankcruptcy may be the only option for him.He doesnt have any assets, we rent our home from a local h/a. All our bills are paid from my bank account(in my name only) He has an overdraft debt of approx £800. He seems to have buried his head in the sand and his attitude stinks, but at the end of the day this needs sorting. Where should he start? Can he apply for bankcruptcy or does the creditors have to proceed with that? Sorry if this sounds thick but i havent a clue as to what he should do. I would let him get on with it if it wasnt for the fact that I will lose sleep thinking about this.

    He can apply for his own bankruptcy.

    Check out the following site www.insolvency.gov.uk which shows you the forms and tells you about bankruptcy and petitioning for his own BR.

    As for burrying his head in the sand, we all do it at some point or another...otherwise probably wouldn't be in the same possition! Hope that helps a little bit and am sure more knowledgable peeps will be on here soon!

    Welcome to the board Elaine.

    The first thing to do is talk to one of the debt charities, see my sig. When you petition the judge will ask if you have had professional advice and you can say yes.

    Hi,

    Br may be a good option but if you go to your local court and ask for a form n244 or n245 and apply to have the judgement varied ( say to £1 per month if he is on income based JSA ) and any enforcement stopped.

    This could buy some time whilst you think about your options.
