06/07/2016 a PCN was issued to a car owner in a parking space belonging to the shop he worked at, the owner said he would sort it....


The shop owner purchased the vehicle shortly after the date of the PCN

The accused went BR in October 2018

No more comms till june this year when DCBL sent a warning...they want £190

Accused replies with all the facts and DCBL back off

Now DCBL Legal try for a CCJ, claiming they have no knowledge of any comms with DCBL....oh yes we have...erm..



So he has informed the court of all the facts and sent a copy of the BR to all parties


can the court kick it out or grant the CCJ on a PCN from before the BR he knew nothing about,etc...

  • Is this a tough one?

    Can/should the court process a CCJ on a charge/debt from pre-BR?

    is any such CCJ enforceable?

    The court has forwarded the victims defence to DCBL and DCBL (Legal)

    Now awaiting replies

    I just don't understand the millions of acronyms, and why on earth a shop owner would buy a car which is parked on his land and subject to a PCN, and not be able to cancel it. Surely he is employing the parking company?

    OK... the car (then) owner did deliveries for the shop (like a takeaway), after the ticket the shop owner bought the car but had said already he would sort the ticket.

    the space was one of 2 the shop was allowed.

    the PCN was issued by a private parking company on the behalf of the land OWNERS...not for the shop owners

    all of that is interesting but irrelevant, its BR-CCJ that is of interest...
  • Aha - well that makes more sense. Very bizarre, why would they bother trying for a CCJ? Even if they get one the court can still cancel it (£255 fee though...).

    DCBL (either or neither) didnt check so were not aware the victim was BR before taking out a CCJ, its upto the court now as they have been told
  • looks like DCBL have seen the light and chosen not to look like the rear of the panto cow in court....
