Question r.e council tax bill after B.R

Hi all, I went B.r last month and it all went very straightforward:D , I've not been working since september due to health problems and was having my council tax and rent paid from income support.
However the council are saying that Me and my partner owed a months council tax previous to the council tax benefit starting and they want paying for it (fair enough), I've explained that I'm B.R and i'll pass the debt to the Or, but they are saying that my partner will have to pay it because we are living together and she is liable for the whole debt.
Is this accurate or should she only pay 1/2 and should my 1/2 be passed onto the Or?

I had debts, my circumstances changed, I tried but couldn't pay them, I dealt with them in the best way I could.........

you areboth joint and severally liable which means you both owe the whole debt, not half each im afraid.

Council Tax is a complicated one as to wether it should be included in BR. PM Fermi and ask him to look at this post. I have a feeling previous years CT can go into BR but current years can't.
You can't split it half and half though. If it is a joint debt then you are both 'jointly and sevrally' responsible for the debt. Which means if one person fails to pay then the other has to pay the full amount. Though with CT I don't know if it is the person who is on the bill or who ever lives in the property who is responsible IE my DH name is on our CT bill, if he goes BR and we owe arrears do I then have to pay as my name isn't on the bill?BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -

In answer to the above c/tax definately goes in to a BR including thecurrent year if a final bill or liability order has been issued.

Thank you both for the replies, we shall contact the council and speak about putting it on a repayment plan, we can't afford to pay it in full at the moment.
