Hi the house has been on market now for 6 months and still unsold with 6 months of mortgage arrears. Went to Court 2nd Nov and now have received an Order for Possession' for 28th November.
I am told by the CAB that nothing will happen till after Christmas but I dont understand what is likely to happen on the 28th Nov.
If and when they do repossess do they become liable for all the utilities, Council Tax and house insurance.
Can someone please advise.
PS in the meantime I have a viewing on Saturday so fingers crossed and what happens if I get a seller before I move out????
thanks

Hi
I am not sure what has happened so far, I think if you havent already you can apply for a suspension of the warrant of possesion this will give you another 28days.
Once the house is repossessed you should give a final meter reading to the utility companies and advise the Council Tax people of your date of moving and your new address. With regards to the Insurance you will have to cancel that as well.
As far as I am aware the Company who repossess do not have to pay utilites or Insurance as no-one is living in the property and it will then just be classed as an empty property until a new purchaser is found.

Hi Japenesegirl
Once the 28 of November has passed the claimants can then apply for a warrant of possession. Even if they apply for the warrant on the 29 November it is unlikely that you will be evicted until January (the courts have an amnesty period over Christmas and dont schedule evictions for this period)
As the above poster said even if this happens, you can still apply to the court to suspend the warrant if you require more time.
Hope all goes well for you on Saturday x xPay Debt by Xmas 16 - 0/12000
