County Court Business Centre Claim

Hi. I have received a claim form for a credit card debt that I owe. I can't remember when or how much I actually owe and sent a letter to the claimant asking for a copy of the credit report.
I received a letter back saying they can confirm the contents (of my letter) have been noted.
Also that I need to respond to the claim form. That was it. No credit agreement sent.
Do they have to send it if they have it?

Hi stoosh66 and welcome to the forum :)

Exactly what paperwork have you received?

Are they the N1 claim form, N9 response pack, N9A admission (specified amount) and N9B defence and counterclaim?

    I have until 31st July.

Until what. Have you acknowledged. What is the date in the top right hand box?

Do they have to have the credit agreement to take me to court? And do they have to provide me with a copy? TIA

If the issue date is 12 July, the service date is 17 July and, as you have acknowledged service you have until 14 August to submit your defence.

Have you made a formal request to the creditor under s77-9 of the consumer credit act? Is that what you meant in post #1?

Have you made a request to the solicitor for documents mentioned in the particulars of claim? That's a cpr request

There is guidance on both these requests and a helpful forum here

You must make the Sec77/79 request, and the CPR request in writing, not in an email, text or phone call, as non of those options are admisable in court.

    Thanks for your replies.
I sent a letter asking them (Hoist finance UK holdings) to send me a copy of my credit report. Looking at the links just posted, I never included the £1 P/O.
The claim form they sent me only mentions a default notice being served. I can't see anything about any other documents.
