Sounds more like a misunderstanding on your part than a mis sale on the mortgage company
Assuming that base rate tracker is ERC free if they were to swap again when part 2 matures.

As above. If your original mortgage rate has now expired. With products often running for more than the full years and often being able to apply earlier to switch the will probably be some combination of fixes that will align the dates.
Some lenders won't merge anyway.
If any overpayment in the pipeline having two parts can give more options.0
