Bankruptcy and moving out?

Hi, I tried to get DRO, but one of the advisors I spoke to said I’m not going to be accepted as I have school/ tutor fees.
In two years time I’m moving back to my country- that’s the plan, and my question is- can I apply for bankruptcy now and say that in two years I’m planing to move out? Will they accept my bankruptcy? As I’ve heard court can refuse it? I have about £12000 debt and I’m not going to be able to clear it all in two years time.

    If you meet the criteria for a DRO, that's going to be easier. I don't understand your explanation of why you couldn't have one.


    Do you fit these criteria?


    •Must not be a homeowner,

    • Debts less than £20,000,

    • Can have a car worth up to £1000,

    • No other assets of more than £1000,

    • Must have £50 or less left at month end, after all essential payments have been made (not inc debt repayments),

    • Cannot have had a DRO in last 6 years.
  • Hi thanks for your response. Basically I spoke today to StepChange, and they have done this budget planner, and I was told my education fees are not acceptable by DRO, I will have to remove them, which will result with more than £50 spare each month, or find “substitute”

    OK, I understand the explanation better but if your fees are part of your usual expenditure, to a recognised educational establishment, and will be paid for the next 12 months, I don't see that this is necessarily a barrier to a DRO. What the guidance says is
    Payments to a private company for a course/qualification that are not from a student loan, bursary etc. are not an allowable expense for a DRO application
    .

    If instead you decide to petition for bankruptcy at £680, that would not stop you from returning to your country.
