Stamp duty question

My boyfriend and myself are looking to buy a property together. He currently owns an apartment with his brother (50% each). He wants to keep that property (as his brother would remain living there) but the house we buy would be his main residence does this mean we wouldn’t have to pay stamp duty? I am a first time buyer.

    If your boyfriend’s existing half share is worth £40,000 or more then it sounds likely that the 3% extra SDLT will be due on the joint purchase.

    It might be different if in the last three years your boyfriend has sold a previous home.
