Need help regarding my debt

  • Just an update, I went to see the Student Advisor in the Union today, she is taking on my case for me, apparently this type of case is extremely common with the NHS Bursaries Unit. She is going to write to Controlaccount and the NHSon my behalf and request all the necessary information and we can then take it forwards. Thank you all who have replied and sent me best wishes and advice, I will keep you updated!

    Thank you Shiney :) Really means so much to the people who you guys take the time to respond to. Just knowing that someone out there is listening can make all the difference.

    I just wondered if anyone can shed any light or expand upon this part of what RAS said...
    I think a letter or a meeting with your MP, pointing out that you recognise that you may owe something but that you had not prior warning (abuse of process)

    Abuse of process, is that an official term and something that could be in my favour if it is applicable to my case, or do companies not actually have any obligation to contact you about a debt prior to involving a debt recovery company? Is there any kind of time limit on how long they have to prove a debt is owed or could they in theory have waited years before chasing me for this?

    I don't believe it. Had another letter this morning saying they are making a Civil Claim against me because I still haven't paid them. Letter was dated 22nd and gave me 48 hours to phone them. Have tried phoning today but they are closed weekends. So I've emailed instead to let them know that a Welfare Adviser is now dealing with my case and they should hear from her next week. Do you think this will get the Civil Claim put on hold? :(

    Does anybody know, if I have signed a consent form allowing the Student Adviser to deal with my case, if they contact Controlaccount on my behalf, with my authorisation, can Controlaccount refuse to correspond with this Adviser on the grounds that "it's your name the debt is under"? :(
