after doing a credit report on myself i discovered a CCJ made against me this year for an outstanding debt from 20 years ago. looking through this site there seems to be a 6 year cut off period. can anyone explain this further for me.
Thanks

I understand that if a debt is statute barred a CCj cannot be made against it. Remember that it is six year since you last acknowledged the debt or made a payment towards it, not since the debt started.

You should also have a right to due process - notice that action will be taken and the chance to defend yourself against it. So you have the right to have the CCJ removed or stayed (I can't remember which, I'll try to find out, but someone who knows more than me should be along soon).

Can I ask who the creditor is - original creditor and who lodged the judgement? PM me if you don't want to post it. Also, I presume that with such shocking disregard for due process it could only have been issued by northampton county court?!
  • Thanks for the info. I thought it seemed a bit "dodgy" after all this time. Do you know if it would be better for me to approach the court to get the CCJ removed ?
