Hi Moneysavers
My OH has an outstanding debt which is over 10 years old, it was originally being managed by Geoffrey Parker Bourne, she has a court variation order on the account which allows her to pay £1 a month
GPB have passed the account to Red Castle Recoveries/Gothia
This company are sending really snotty letters threating attatchment of earnings, baliffs, more court action
My question is have they any legal right to take the account to court again?
It appears that GPB have failed to notify Red Castle that a variation order exsists
Should she say nothing and let them make fools of themselves?, or should she contact them to disscuss the matter?
She acknowledges the debt and is not going down the statute barred route
Thanks in advance for your help

The new 'owners' of the debt would have to first apply to the court to amend the name of the claimant before they could take the matter back to court. They can apply to vary the varied order (if that makes sense!) however you would be notified of the hearing date and would be able to attend to put your side forward. All of this will attract a court fee for them and I should imagine that these are just threatening letters.
If your wife is in any doubt she always give the court a quick ring to see if any contact has been made recently by the claimants. x xPay Debt by Xmas 16 - 0/12000
