next won't refund direct debit overpay

    My bank says they can't help. I can't get to a someone with clout at Next . Interesting that they took the money when I had paid in full and closed account ...I 've no idea what to do next .

    Maybe start by giving us more information otherwise nobody here will be able to help. Can you answer some of the questions which have been asked by posters on your thread?

    are you certain this was a direct debit and not a standing order? If a direct debit, no payment should have been taken unless you made a separate payment close to the DD date (too late for them to stop it)
    If that is the case your account would be in credit

    Your bank cannot refuse to refund you under the DD guarantee. FULL STOP! No ifs, no buts, they have to comply with a requested refund.

    Are you sure it's a DD?

    A bank must immediately refund a DD if requested by the account holder. They cannot deny this request.

    Phone them back and say you want them to reverse the payment under the terms of the DD guarantee. Escalate to a complaint immediately if not.

    Sadly the advice being provided is being hampered by a complete lack of meaningful information.

    In order to get more helpful advice can you show copies of all communication between yourself, Next and the bank please? Make sure it's redacted of all personal information.
  • It was a direct debit .
    Nationwide on my instructions attempted to reclaim the money from Next .
    Two months on I received a letter from my bank Nationwide stating that despite trying to get a refund from Next's...bank Hsbc, Next will not sanction the payment . Nationwide cannot help me further and hav e suggested the financial ombudsmen or claims court.

    Try going to the Ombudsman. If that fails sue Next.

    Nationwide have no choice (or say) in the matter ... the direct debit guarantee means they (Nationwide) HAVE to give you your money back, doesn't it?

    Have you exhausted Nationwide's own complaints procedure? Have they said why they think the direct debit guarantee doesn't apply?

    The lack of coherent information really isn't helping here. That's why I asked for all the correspondence between the three parties. Sadly it hasn't been forthcoming.
