Quick ccj question please

Apologies if a silly question and just curious but can a CCJ be registered on a credit file without prior warning or any notification to the debtor?

    Yes, it’s called a “judgement by default”.

    If the creditor holds an old address for you, and hasn’t bothered to do a more recent trace, then all paperwork can go to that old address, and the first you know of it is when you best check your credit file.

    But otherwise if no address issue full notification in some form should be given?

    Yes, a letter before action should be received first, this is a part of the civil procedure rules, pre-action protocol, it’s a questionnaire type document that allows both parties to agree a mutually acceptable solution without the need to progress to court.

    If this cannot be achieved, then a claim form is the next step in the process, and the matter gets dealt with by the court.
