Hi all I am new to the forum and would like some advice.
My partner has revived a letter from lowell stating she has a ccj and need money to creation consumer finance. I have checked her credit report and this is confirmed.
I have been with my partner for ten years and the debt related to a children's photo shoot that took place in 2008 but the package was sent back and not accepted no payment ever made.

The ccj was applied by Nottingham court in 2015 no papers ever received and now lowell are chasing this debt.
I am a very astute person and financially secure have a good credit rating and not apposed to paying this debt if needs be.

I would just like to know where I stand in setting this aside beforehand as it's 7 years between the initial credit agreement and the ccj being applied in 2015. Like I said the initial credit agreement was taken out before I got with my partner and as we get married in 2 months I would like to resolve this as soon as possible

Thanks

Wayne

    Hi,

If seven years have passed, with no payment or written acknowledgement, then the debt would have been statute barred, prior to judgement, yes.
The Limitations act stipulates 6 years is time enough to recover a debt.

The cost of a setaside is £255.00, with remision for low earners.

The only thing against you is the time that has past since judgement, courts expect you to "act within a reasonable timeframe", if you have only just become aware of this, then they may accept that is reasonable.
