Me and my partner have recently seperated and she has moved out. We have a joint account in which the mortgage is paid every month.
At present we haven't decided what we are going to do about the house. She hasn't paid towards to mortgage this month and I doubt very much she will be doing.
In the eyes of the law we are both held responsible if a payment isn't made so its been left for me to pay in full.
Is there anything I can do to get round this other than to pay in full?
Obviously I do not want the house repposessed or my credit rating affected.
Also what are the implications of her non-payment? Can I claim payments back in a small claims court?
Is there any way I can prove non-payment? Are there any laws that may work in my favour here? Is there anything handy to know which may help me.
Thanks

Suggest that whatever you contribute post separation is factored into the division of equity upon sale of the property. Make a clean break whatever you decide to do.0

Sell the property ASAP if she won't or can't afford to pay her 50%0
