Where do I stand if completion doesn't happen today?

    Well housing association emailed about 20 mins ago to say that all documents are now with my solicitors so they will be preparing my file for completion today, hoping nothing else delays it. I want me keys!

    Edit, just got a text from solicitors to say I have exchanged. So if it doesn't happen now at least is sounds like I can claim for the hotel :)

    Whilst I generally agree we've gone too far to far along the line of blaming everyone else for our mistakes and always looking for a claiming culture, you only have to look at the weekly "I was Missold a mortgage/loan I asked for" thread you see around here.

    however if somebody has exchanged contracts agreeing vacant possession of a house by a certain time on a certain date and that doesn't happen then it's only right that the other party can claim for any reasonable costs that come up due to someone not doing what they signed a contract agreeing to do.

    I dont think you have read the thread. The OP was in the hotel BEFORE they had even exchanged. They are ex and comping on the same day.

    Speaking as someone who has recently been in the unpleasant position of having to plan a move around same day exchange and completion, it's hardly fair to suggest the OP is jumping the gun here. You can't just put everything else on hold until the legals are sorted, otherwise you could be in trouble if it does all go through. In my case, we didn't actually manage to exchange till 3pm, by which time all my worldly possessions had longsince been packed into the moving van. If we'd waited for the call that we'd exchanged to even start, I might have ended up liable for failing to provide vacant possession. Not to mention the fact that movers don't get booked or cancelled at the last minute. I had to book 10 days in advance, pay my non-refundable deposit, and hope really hard.

    I don't understand why anyone would put themselves through the stress of trying to exchange and complete on the same day.

    True, but I think the previous poster had been under the impression that exchange had occurred. Obviously (I hope) if you haven't exchanged contracts then you can't claim against the other party for breach of contract. Any preparations you do prior to exchange are at your own risk.
