Uncle Buck PDL

Has anyone had any luck with claiming interest charges back?

They’ve sent their final response, declining my claim, and insinuating I lied on my application regarding income.

I was only working when applying for my first loan. They claim to have done checks each to me I applied to confirm I had an income. They clearly didn’t as there wasn’t one.

They say they asked income on each application. They didn’t. They asked about my outgoings.

They specifically told me my loans wouldn’t appear on my credit file as they were small amounts - each under £500. They all show which is going to make applying for a mortgage difficult.

I’ve now referred to the ombudsman.

Am I wasting my time?!

    Sorry, just to clarify the above, you were working and receiving a salary when you took out the first loan from Uncle Buck but not the subsequent loans?

    Do you have evidence that they never asked for income on subsequent loans?

    it might be that their terms and conditions state that you must have an income before applying for loans. Their get out will be that you accepted the terms and conditions for the first loan so were fully aware of them for subsequent loans.

    You might have a problem here (but am sure someone else more knowledgeable will be along to advise) as they could argue that you lied on your subsequent loan applications (lied by omission rather than actually told them a mis-truth).

  • Yes, working when loan 1 was taken out.

    Student for the others.

    I’ve looked through their T&C and cannot see anything that says you must be in employment.

    They claim to have done an employment check on each application and I passed.

    How can that have happened when I wasn’t working?

    They also performed a hard search in February this year, but I had no applications then.

    Yes you should most definitely refer this to the ombudsman.

    The final response I received was a joke.

    ‘If you were struggling to pay, why didn’t you default, or make late payments?’

    Littered with spelling mistakes too.

    I’ve requested all the details I apparently provided, and have had no response, apart from a screen shot of folders on their computer!
  • Just for the record I didn’t pay late as I didn’t need extra charges.

    The default aspect speaks for itself!!

    I’m a bit worried that they’re claiming I lied on the application, and mentioned fraud.
    You could make a SAR request to check what data they hold on you.
    I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

    They replied saying they are happy to provide the information to the ombudsman should they request it.

    I specifically asked for them to send directly to me, and they’ve not responded since.

    Good morning,

    Thank you for your recent email.

    We will happily cooperate with the financial ombudsman, and submit a business file with all information upon their request.

    I have provided the information I had via email yesterday, I have a further four files verifying the same information. As you applied declaring that you were working and the information that we had collaborated your declared salary, your loans were funded. We believe that our customers apply honestly, as to falsify information on an application, is deemed as application fraud.

  • Hiya - not sure if you've visited this site but it's been helpful for a lot of people and has a section which I believe covers what you're referring to - Uncle Buck are certainly not the only company to make accusations :)
