Holiday after bankruptcy

I went bankrupt on the 8/4/19 most of my debtors were credit card providers, in January 2019 i paid for a 5 night holiday(flight & hotel) with one of the credit cards, at the time this was purchased i had no idea i would be bankrupt, I know this would be morally wrong but would i still be able to take this holiday? Or would it be illegal?

    On the assumption that the holiday has already been paid for and cannot be cancelled, this amount presumably forms part of your debt

    If you can cancel it and get a rebate then the OR should instruct you to cancel....assuming you will need spending/eating money on your nice holiday -do you have enough cash or did you already buy your foreign currency?

    I would go... who’s going to know?! If it’s paid in full that is.
    There won’t be putting any more holidays on finance for the next 6 years anyway and one would hope you would not get back in this situation again.

    I suspect the OP will be eating whether or not on holiday.

    Assuming the lender has not pulled money out as it's not a past transaction it's pretty much fully paid.

    If the lender did took the money back from the merchant due to your situation, you will not have a chance to go for those holidays.

    The other thing is, if you are a Bankrupt you have legal things to follow now, and if anyone finds out you will pay those money back anyway.

    If there is an option to cancel then the OR may ask you to. But if it’s not £1,000s then they probably won’t worry about it. It’s best to inform them though because if they check your statements and see the transaction then it’ll only raise eyebrows if you’ve not told them. And then they'll just look at all your spending more closely.

    I paid for some (fairly cheap) summer flights and a hotel the January before my June bankruptcy. Also quite a bit of money on a college course the same summer. The OR never even brought it up - the holiday couldn't have been cancelled but the course could have returned something like 75%. I had visions of the OR phoning the provider up and getting me blacklisted, but of course they never mentioned any single transactions. In fact, I continued using the card for small, unavoidable living expenses like food and petrol until a couple of weeks before bankruptcy.

    The OR gets hundreds of bankruptcies a day. I guess it's too much effort to look at individual transactions and investigate whether they can be refunded/cancelled (unless they were for £000's). Remember, your holiday is probably not refundable anyway, the OR has no idea of the dates and whether it's already happened, and no way to prove you knew you were going bankrupt back in January.

    I do know of one case where an expensive holiday was cancelled and the refund went to the OR.


    Also, if you are in Northern Ireland and bankrupt, you need the consent of the court to go overseas.

    Maybe there was a huge £3000 transaction to centre parcs just after Xmas!

    In my case I was rather lucky as the transaction was to Transferwise to convert the currency before paying, so the OR couldn't see what it was for and never bothered asking...
