How far down the road of explaining a second charge the solicitor should have gone is debatable. At the very least he should he have said the loan is secured on the property rather than unsecured.
Unfortunately in their haste to obtain the "prize". People far too often either don't read the documentation they are provided with nor listen to what is said to them properly at the time. Recollections even a week later are bound to be hazy. Events that happened years ago there's no possibility of relating what was said at the time accurately. Over the years I've seen many a business tied into an onerous supply contract for the lack of due diligence.
Due diligence before signing any legal contract should always be a must. As the contract itself will stand up in a court of law.0 -
Thanks for that that Silvercar! Like I have said previous I now understand the question was probably not well thought out but I appreciate the posters that did get back to me with valuable knowledge. I now know not to pursue whatever I originally thought.
