Employer refuses to provide a P60?

Hello,

My girlfriend and I have finally saved up enough to buy a house and have had an offer accepted :T

We are now getting all the required information together for a mortgage application (we already have our agreement in principle). One of the items requested is your latest P60.

My girlfriend works for a large fashion retailer and started work there in November 2018. When she asked for her P60, they have told her that she is not entitled to one.

My understanding of a P60 is that everyone employed by the company at the end of the tax year should receive a P60? Is this correct? Also, if her employer continues to be awkward, do you guys think it would be possible to provide the P45 and P60 of her previous employer?

    Yes, her current employer must provide a P60 but they do have until 31 May to do so. Has she been getting payslips?

    Was she employed by them on 5th April 2019?

    Have they said that they won't ever or that she will have to wait as I can't remember the exact dates but they have till around 1st June 2019 to provide one.

    Does she pay tax as they are only obliged to provide one if have had to deduct tax during the tax year?

    31st May 2019 is the deadline for the P60 to be provided I understand. Just got mine last week. P11d's (additional benefits such as health insurance) deadline is later - july I think.

    In the mean time, the mortgage provider should be aware of this. They may accept last years P60 plus recent payslips, or just wait the two weeks until you receive it.

    If the employer is saying you wont get one, then thats wrong.

  • Just a thought if the info is needed urgently (ie before the deadline) what about using the last payslip of the tax year....that would have more or less the same info on it.

    This is totally wrong. Providing the employer considers her an employee at the end of the year then a P60 should be provided.

    Given that the op's girlfriend works for "a large fashion retailer" a more likely explanation is that she has spoken to to someone in her local shop/branch, who knows about about payroll procedures, rather than the actual payroll people who will know what they need to do.

    Under Rule 67 it only needs to be provided if tax is deducted from relevant earnings.
